Board of Trustee Minutes 01/26/2015

A regular meeting of the Board of Trustees of the Village of Delhi was held on Monday, January 26, 2015 at 6:00 p.m. in the Village Hall Boardroom.

Present:               Mayor:                 Richard Maxey (absent)

Trustees:             Jeremy Fitch, Greg Krzyston, Chris Maney, Robin Hultenius

The meeting started with the Pledge of Allegiance at 6:00 p.m.

Motion was made by Trustee Fitch to approve the minutes of the December 15, 2014 regular meeting, and the budget workshops of January 5, 2015, January 12, 2015 and January 21, 2015.  Motion was seconded by Trustee Krzyston and passed unanimously.

Motion was made by Trustee Fitch to approve the Abstract dated January 26, 2015 totaling $284,146.12 with additional vouchers ($184 to Chris Hillis and $3572.52 to Turnkey Solutions).  Motion was seconded by Trustee Krzyston and passed unanimously.

Motion was made by Trustee Hultenius to approve the HUD Report for December, 2014, the Police Report for December, 2014, the Police 2014 Annual Report, the Code Enforcement Officer’s Report for 12/12/14 – 1/22/15, the DPW Superintendent’s Report dated 1/22/15 and the Treasurer’s Report for December, 2014.  Motion was seconded by Trustee Maney and passed unanimously.

Kevin Brown, of Zippy Solutions, LLC was present to discuss with the board the security system at the village hall and the water plant/street garage.  He left a proposal for the board to review.

Motion was made by Trustee Maney authorizing the Mayor to sign the Month Participation Agreement with the New York State Teamsters Council Heath and Hospital Fund.  Motion was seconded by Trustee Hultenius and passed unanimously.

Motion was made by Trustee Fitch to give Dave Truscott partial reimbursement of the expenses he incurred related to a village sewer line issue, in the amount of $1,050.  Motion was seconded by Trustee Krzyston and passed unanimously.

Motion was made by Trustee Maney to hire Robert Sprague, Jr. as a crossing guard at a rate of $12.00 per hour.  Motion was seconded by Trustee Fitch and passed unanimously.

Motion was made by Trustee Fitch authorizing the Mayor to sign the Annual Software Support Contract with Williamson Law Book for the Payroll software and directing the Clerk to remit $726 with said contract.  Motion was seconded by Trustee Krzyston and passed unanimously.

Motion was made by Trustee Maney authorizing the Mayor to sign the Annual Software Support Contract with Williamson Law Book for the Municipal Accounting software and directing the Clerk to remit $726 with said contract.  Motion was seconded by Trustee Hultenius and passed unanimously.

Motion was made by Trustee Hultenius to pass Resolution #1 of 2015 entitled “Resolution by the Village of Delhi Board in Relation to Agreement for Mandatory CDL Drug & Alcohol Testing”.  Motion was seconded by Trustee Krzyston and passed unanimously.  Resolution reads as follows:

WHEREAS, the Federal Highway Administration (FHWA) has adopted and published regulations at 49 C.F.R. Part 382, entitled “Controlled Substances & Alcohol Use and Testing”; and

WHEREAS, these regulations apply to all Public Employees holding CDL licenses and who perform safety sensitive functions; and

WHEREAS, the regulations require the testing of all personnel who are covered; and

WHEREAS, the regulations allow for the Consortiums to be formed by groups of employers to administer the regulations as a single entity; and

WHEREAS, the County of Delaware has agreed to administer a consortium for all the Towns and Villages in the County.

NOW THEREFORE BE IT RESOLVED that the Village of Delhi Board approves the Highway Superintendent signing an agreement with the County of Delaware for the mandatory 49 C.F.R. Part 382, “Controlled Substances & Alcohol Use and Testing”.

Motion was made by Trustee Maney authorizing the Mayor to sign the Agreement for CDL Drug & Alcohol Testing with the County of Delaware.  Motion was seconded by Trustee Krzyston and passed unanimously.

Motion was made by Trustee Maney to support the 5th Annual St. Patrick’s Day Parade sponsored by the Delaware County Department of Economic Development.  Motion was seconded by Trustee Krzyston and passed unanimously.

Motion was made by Trustee Maney authorizing the Mayor to sign the 2015 Town Planning Advisory Service Contract and directing the Clerk to remit $3500 with said contract.  Motion was seconded by Trustee Fitch and passed unanimously.

Discussion was had about approving the TEP bids.  The Board tabled it to further evaluate the bids and revisit it at the next meeting.

Motion was made by Trustee Fitch to authorize the Mayor to attend the NYCOM winter meeting February 8-10, 2015.  Motion was seconded by Trustee Krzyston and passed unanimously.

Motion was made by Trustee Krzyston to set a public hearing on February 23, 2015 at 7:00 p.m. for the purpose of discussing a tax cap override.  Motion was seconded by Mayor Maxey.  Motion failed with Trustee Krzyston and Mayor Maxey voting yes and Trustees Maney,  Fitch and Hultenius voting no.

Motion was made by Trustee Fitch to adjourn.  Motion was seconded by Trustee Maney and passed unanimously.

Meeting adjourned at 7:26 p.m.
