Board of Trustee Minutes 07/21/2014

A regular meeting of the Board of Trustees of the Village of Delhi was held on Monday, July 21, 2014 at 6:00 p.m. in the Village Hall Boardroom.

Present:           Mayor             Richard Maxey

Trustees          Jeremy Fitch, Dan Ayres, Chris Maney

The meeting started with the Pledge of Allegiance at 6:00 p.m.

*all unanimous votes are unanimous WITHOUT the Mayor voting, unless otherwise noted.

Motion was made by Trustee Ayres to approve the minutes of the June 16, 2014 regular meeting.  Motion was seconded by Trustee Fitch and passed unanimously.

Motion was made by Trustee Ayres to approve Abstract dated July 21, 2014 in the amount of $108,031.55.  Motion was seconded by Trustee Maney and passed unanimously.

Motion was made by Trustee Maney to pay Delta Engineers $8,625.00, which represents 75% of the total invoice for the Riverwalk Survey.  The remaining 25% will be paid when the work is complete.  Motion was seconded by Trustee Ayres and passed unanimously.

Motion was made by Trustee Fitch to accept the Police Report for June, 2014, the Code Enforcement Officer’s Report for 6/12 – 7/16/14, and the DPW Superintendent’s Report dated July 15, 2014.  Motion was seconded by Trustee Ayres and passed unanimously.

The Board discussed a request by Wendy Phillips for cancellation of the violation and removal fee for lawn maintenance at 43 Franklin Street.  The Board took no action, and will still be following the Village’s policy.

Motion was made by Trustee Ayres to approve a proposal for a fire escape tower design by David Hultenius in the amount of $3500, and to remit a $1750 deposit to Mr. Hultenius.  Motion was seconded by Trustee Maney and passed unanimously.

Motion was made by Trustee Ayres to approve the following members of the Flood Commission:  Matthew Krzyston, town councilman; Christopher Maney, village trustee; Ken Pyle, town resident; Daren Evans, fire chief and town highway superintendent; Jack Tessier, SUNY Delhi representative; Liz VanBuren, town business representative; Ed O’Neill, village business representative; David Curley, village public works superintendent; Christina Viafore, village resident.  Motion was seconded by Trustee Fitch and passed unanimously.

A list of delinquent Village taxes was presented to the Board.  They are as follows:

8 years:           Steven Salerno ($4,413.67), Thomas Schimmerling ($14,466.35)

5 years:           Magdy O’Kelly ($97.05)

4 years:           Andrew Street LLC ($43,332.06), Delhi Group LLC ($4,069.33), Jackie Miskovitz ($2,805.86)

3 years:           Richard Babcock ($4,502.02), Depot Street Development ($4,488.24), Melinda Gaidemak ($5,360.40), Salerno-Delhi Realty ($8,684.53), Stevenkelley, LLC ($2,823.59)

2 years:           Kevin Bedient ($1,502.89), Thomas Casey ($1,532.93), Sibel Finn ($1,532.93), Daniel Horton ($2,564.91)

Motion was made by Trustee Fitch to approve the purchase of medals for the little league players.  Motion was seconded by Trustee Ayres and passed unanimously.

7:00 p.m.:  Motion was made by Trustee Maney to open the public hearing on proposed Local Law #2 of 2014 entitled “Local Law Adding a Tax Relief for Homeowners to the Code of the Village of Delhi”.  Motion was seconded by Trustee Fitch and passed unanimously.

There was no public comment

Motion was made by Trustee Maney to close the public hearing.  Motion was seconded by Trustee Ayres and passed unanimously.  Public hearing closed at 7:15 p.m.

Motion was made by Trustee Maney to adopt Local Law #2 of 2014 “Local Law Adding a Tax Relief for Homeowners to the Code of the Village of Delhi”.  Motion was seconded by Trustee Fitch and passed unanimously.

6:45 Patricia Nabinger addressed the Board with pictures and video concerning the stormwater drainage issues in front of her house on Cross Street.  Mayor Maxey stated that work won’t be able to be done on it until next year.  Trustee Ayres asked that she talk with DPW Superintendent Curley to see if there is some sort of mitigation that can be done in the meantime.

Motion was made by Trustee Fitch to accept the resignation of Trustee Dan Ayres effective July 31, 2014.  Motion was seconded by Trustee Maney and passed unanimously, with Mayor Maxey voting.

Mayor stated that road paving will start August 6th and go through August 8th for the following streets:  Church Street, Clinton Street, Court Street, Crestwood Circle, Cross Street, Delview Extension from the circle to Phoebe Lane, Delview Terrace to #10 and #10 to #2 Delview, Park Place, Prospect Street from pump house to #26, Second Street, Sheldon Drive, Spruce Street and Franklin Street.

Motion was made by Trustee Maney at 7:20 p.m. to enter into executive session to discuss the employment history of a particular person.  Motion was seconded by Trustee Fitch and passed unanimously.

Motion was made by Trustee Maney to exit executive session.  Motion was seconded by Trustee Ayres and passed unanimously.

Open session resumed at 7:35 p.m.

Motion was made by Trustee Maney to move forward with installing bathrooms at Sheldon Park using up to $20,000 from the Timber Fund.  Motion was seconded by Trustee Ayres and passed unanimously.

Motion was made by Trustee Fitch to adjourn.  Motion was seconded by Trustee Ayres and passed unanimously.

Meeting was adjourned at 7:43 p.m.
