Board of Trustee Minutes 01/27/2014

A regular meeting of the Board of Trustees of the Village of Delhi was held on Monday, January 27, 2013 at 6:30 p.m. in the Village Hall Boardroom.

Present:           Mayor             Richard Maxey

Trustees          Gregory Krzyston, Jeremy Fitch, Dan Ayres, Chris Maney

The meeting started with the Pledge of Allegiance at 6:30 p.m.

*all unanimous votes are unanimous WITHOUT the Mayor voting, unless otherwise noted.

Privilege of the floor was granted to Matthew Krzyston who stated that the Catskill Mountain Club was hoping to develop some trails behind Delaware Academy School, both on the school property and village-owned property.  He stated there would be no outside materials brought to the property, and all landscaping, etc. would be done using natural materials already on that property.

Motion was made by Trustee Maney to approve the development of hiking trails on village-owned property behind Delaware Academy schools, pending the Delaware Academy’s approval of the same.  Motion was seconded by Trustee Ayres and passed unanimously.

Motion was made by Trustee Fitch to accept the minutes of the regular meeting of December 16, 2013, and budget workshops of January 6 and January 13, 2014.  Motion was seconded by Trustee Maney and passed unanimously.

Motion was made by Trustee Fitch to approve the Abstract dated January 27, 2014 in the amount of $194,839.99, with additional vouchers of $75 out of the water fund and $500 out of the TEP fund.  Motion was seconded by Trustee Ayres and passed unanimously.

Motion was made by Trustee Fitch to reimburse the IDA for expenses related to the pipeline and pumpstation between the WWTP and the industries.  The amount of $2,401.34 will be paid out of the Village’s “Pipeline-Pumpstation” account.  Motion was seconded by Trustee Maney and passed unanimously.

Motion was made by Trustee Fitch to accept the following reports:  Police Report for December, 2013, Police Annual Report for 2013, Code Enforcement Officer’s Report for 12/12/13 – 1/23/14, Treasurer’s Report for December, 2013 and DPW Superintendent’s Report dated January 23, 2014.  Motion was seconded by Trustee Krzyston and passed unanimously.

Tom and Amy Engels were present to ask the Board to consider a zoning map change for their property at 180 Main Street.   Mayor Maxey will be contacting the Village Attorney to determine the process which needs to be followed to consider a map change.

Motion was made by Trustee Fitch to authorize the purchase of a lap top for the water department for the programming of the new water meters at a cost of up to $1,000.  Motion was seconded by Trustee Maney and passed unanimously.

Motion was made by Trustee Maney directing the Mayor to sign the “Notification of Appointment of Registrar of Vital Statistics” which appoints Nancy Lee as Registrar, and Donna Anderson as Deputy Registrar.  Motion was seconded by Trustee Fitch and passed unanimously.

Motion was made by Trustee Maney to approve the Landscape Architectural Design Services Agreement for the Riverwalk.  Motion was seconded by Trustee Krzyston and passed unanimously.

Motion was made by Trustee Maney to adopt Resolution #1 of 2014 titled “Joint Sale of Tax-Acquired Properties by Village of Delhi and County of Delaware” regarding a percentage split of proceeds from sale of foreclosure properties between the Village and the County.  Motion was seconded by Trustee Fitch and passed unanimously.  Resolution is as follows:

AND

COUNTY OF DELAWARE

 

WHEREAS the County of Delaware has proceeded to foreclose on the following properties in the Village of Delhi; and

WHEREAS it is in the best interest of the Village and the County of Delaware to work together to protect the Village tax lien;

NOW, THEREFORE, BE IT RESOLVED that the County of Delaware shall sell the interest of both municipalities, The proceeds from said sale shall be divided in proportion to the taxes owed each entity for the years 2012-2013.  Each parcel to be treated individually.

** Taxes Owed:                   Each property should be listed with amount of 2012-2013 taxes with penalty and interest due as of July, 2014

Motion was made by Trustee Maney authorizing Delaware Engineering to provide design services for work needing to be completed on water and sewer line at the pool entrance road at a cost of $,4000. Motion was seconded by Trustee Ayres and passed unanimously.

Motion was made by Trustee Fitch authorizing the Mayor to sign a grant acceptance letter for the O’Connor Foundation for a $500 grant to be used toward training expenses of interns of the police department.  Motion was seconded by Trustee Krzyston and passed unanimously.

Motion was made by Trustee Fitch to authorize the water department to purchase water meters and water meter parts in amounts up to $20,000 above what was budgeted.  Motion was seconded by Trustee Maney and passed unanimously.

Motion was made by Trustee Maney to surplus the old sludge container of the WWTP, with a minimum bid of $500.00.  Motion was seconded by Trustee Fitch and passed unanimously.

Motion was made by Trustee Maney to reimburse the Town of Delhi for 50% of the cost of a portable ice skating rink.  Motion was seconded by Trustee Ayres and passed unanimously.

Motion was made by Trustee Maney at 8:50 pm to enter into executive session to discuss contract negotiations and litigation.  Motion was seconded by Trustee Fitch and passed unanimously.

Motion was made by Trustee Fitch to exit executive session.  Motion was seconded by Trustee Maney and passed unanimously.

Open session resumed at 9:26 p.m.

Motion was made by Trustee Fitch authorizing the village attorney to move forward with injunction on a Main Street property.  Motion was seconded by Trustee Ayres and passed unanimously.

Motion was made by Trustee Ayres to adjourn.  Motion was seconded by Trustee Fitch and passed unanimously.
