Board of Trustee Minutes 10/15/2012

 

A regular meeting of the Board of Trustees of the Village of Delhi was held on Monday, October 15, 2012 at 6:30 p.m. in the Village Hall Boardroom.

Present:               Mayor                 Richard Maxey
                           Trustees              Gregory Krzyston, Christopher Maney, Jeremy Fitch, Gerry Pilgrim                 
                           (Trustee Chris Maney absent)

The meeting started with the Pledge of Allegiance at 6:32 p.m. 

Privilege of the floor was granted to Virginia Hoyt, Kevin Lee and Relly Guevarra. 

Motion was made by Trustee Fitch to approve the minutes of the regular meeting of September 17, 2012.  Motion was seconded by Trustee Krzyston and passed unanimously. 

Motion was made by Trustee Fitch to approve the abstract dated October 15, 2012.  Motion was seconded by Trustee Krzyston and passed with Mayor Maxey and Trustees Krzyston and Fitch voting yes and Trustee Pilgrim voting no. 

Motion was made by Trustee Fitch to accept the Bingo Inspection Reports for9/19/12 and 10/10/12, the Police Report for October, 2012, the Code Enforcement Officer’s Report for 9/13 – 10/11/12, the HUD Report for October, 2012, the Treasurer’s Reports for August and September, 2012 and the DPW Superintendent’s Report dated October 12, 2012.  Motion was seconded by Trustee Krzyston and passed unanimously. 

***Mayor Maxey announced the Halloween would be celebrated in the Village on October 31, 2012 during the hours of 4 p.m. and 9 p.m. 

Mary Taylor and Whitney Hill of the Catskill Center gave a report on their Ash Tree Community Inventory Report.  

Bill Brown from Delaware Engineering was present to give an update on the water system improvement project.  All Phase 3 construction is complete including watermains and services, and paving.  

Motion was made by Trustee Krzyston approving Change Order No. 3 to contract VD1-G-11 for a net credit of $10,751.50 which will yield a final contract price of $1,833,035.50 for Phase 3 of the Water System Improvement Project.  Motion was seconded by Trustee Pilgrim and passed unanimously. 

Motion was made by Trustee Krzyston authorizing the Mayor to sign final pay request #5 for Contract VD1-G-11 for $238,505.15, and upon concurrence by USDA Village clerk may issue payment to Merritt Construction in the requested amount of $238,505.15.  Motion was seconded by Trustee Fitch and passed unanimously. 

Motion was made by Trustee Pilgrim authorizing the Mayor to sign proposal by Alpha Geoscience dated 10/11/12 to perform evaluation of potential well sites.  Motion was seconded by Trustee Fitch and passed unanimously. 

7:17 p.m. Public hearing began on proposed Local Law #2 “Amending the Water Law in the Code of the Village of Delhi”.

            Trustee Fitch stated that he believes that the Village has too many restrictions as it is and is opposed to enacting the proposed local law.

            Trustee Pilgrim stated that the law would prevent the drilling of private wells which can create an infiltration problem for the village’s water system.  Trustee Pilgrim is opposed to banning closed circuit geothermal wells.

            Virginia Hoyt asked if current wells would be grandfathered in, and Mayor Maxey said they would.

            James Robbins, and Kevin and Nancy Lee stated that property owners with curb stops that do not use the water, should not have to pay anything, and that the village should not have replaced the existing curb stops at vacant properties with new ones during the water project.  Mayor Maxey stated that the availability of water is valuable to a vacant piece of property and people pay for the availability.

            Trustee Pilgrim made a motion to table the proposed local law so that some amendments can be made and a complete copy of the law can be provided by the Attorney.

            Motion was made by Trustee Pilgrim to close the public hearing.  Motion was seconded by Trustee Fitch and passed unanimously.  Public hearing was closed at 7:38 p.m. 

7:38 p.m.  Public hearing began on the issue of whether or not to reintroduce fluoride to the village’s water system.

            Jane Hamilton (Public Health), Audrey Lewis (NY Department of Health), Cyndee Cobb, Dan Ayres, Dr. Hubner, Antha Robbins and Virginia Hoyt all spoke to the benefits of fluoridating the water and all encouraged the Board to reintroduce fluoride to the water system.

            James Robbins wanted the representative from the Department of Health to know that the village stopped fluoridating the water after there was a chemical accident at the water treatment plant.  He wants the Board of Health to assist the village in making the water system safe and wondered if the Board of Health had inspected the plant since the accident. 

Motion was made by Trustee Fitch to reintroduce fluoride into the village’s water system.  Motion was seconded by Trustee Krzyston and passed unanimously. 

Motion was made by Trustee Pilgrim to authorize the Mayor to sign the Notification of Appointment of Registrar of Vital Statistics presented by the Town so that they may replace an employee in that department.  Motion was seconded by Trustee Krzyston and passed unanimously. 

Motion was made by Trustee Pilgrim to schedule a public hearing on proposed local law #3 “A Local Law adding a Nuisance Parties Law to the Code of the Village of Delhi” for Monday, November 19, 2012 at 7:15 p.m.   Motion was seconded by Trustee Fitch and passed unanimously. 

Motion was made by Trustee Krzyston stating that the Public Works Supervisor shall have a minimum salary of $2.00 per hour more than the highest paid Teamster employee, effective June 1, 2012.  Motion was seconded by Trustee Fitch and passed unanimously. 

Motion was made by Trustee Fitch to pay membership dues to the Coalition of Watershed Towns in the amount of $850.  Motion was seconded by Trustee Krzyston and passed unanimously. 

Motion was made by Trustee Fitch to purchase a new computer for $999 from ISD in Oneonta to replace the Clerk’s computer.  Motion was seconded by Trustee Pilgrim and passed unanimously. 

Motion was made by Trustee Krzyston to adjourn.
